Terms of use

1. What CakeQ is
CakeQ (cakeq.app) is a service for bakers: a shareable link where an AI assistant chats with the baker's customers, collects the details of a cake order and delivers them to the baker as a request. CakeQ is operated from Chicago, Illinois, United States.
The service is offered by CakeQ ("we", "us"). Contact: cakeqsupport@gmail.com.
2. Your account
You need an account to use the workspace. You are responsible for keeping your password private and for what happens under your account. You must be at least 18 years old and using CakeQ for a business you run or work for.
You can delete your account at any time from Settings. Deleting it removes your bakery, every request, every photo and your sign-in.
3. What the assistant does and does not do
The assistant collects information. It does not give final prices, does not confirm dates, does not take payments and does not enter into any agreement with your customers on your behalf. Every request is a request until you accept it.
The assistant uses an AI model. It can make mistakes. Read each request before you rely on it, especially names, dates and the text to write on a cake.
The assistant is offered in English and Spanish: the languages we support and test to the same standard. If a customer writes in another language, the assistant may answer in that language when it can, without any guarantee, or in English. We may add languages over time.
CakeQ processes cake-order information and your bakery profile only. The chat is not a place for sensitive personal data: Social Security, bank account, card, passport or license numbers are removed by CakeQ when they arrive and are never stored, and a chat where they are sent repeatedly is closed.
4. Your customers
Your customers do not need an account. When they use your link, they share their name, contact and order details so that you can quote them. You are responsible for how you handle that information once you have it, in line with the law that applies to your business.
Do not use CakeQ to collect information for any other purpose, to send unsolicited messages, or in any way that is unlawful, harmful or abusive.
5. Fair use and protection
To keep the service working for everyone there are limits on the number of conversations per link per day and per visitor. Abusive or off-topic use of a link may be closed or blocked automatically. We may suspend an account that harms the service or other users.
6. Price
CakeQ is currently free. If paid plans are introduced, we will announce them in advance and no charge will apply without your explicit agreement.
7. Availability and changes
We work to keep CakeQ available, but we do not guarantee that it will be uninterrupted or error-free. We may change or improve the service, and we may stop offering it with reasonable notice. We are not liable for indirect losses, including lost orders, arising from the use of or inability to use the service, to the extent permitted by law.
8. Content
You keep the rights to what you put into CakeQ: your menu, your rules, your requests. You give us permission to store and process it to provide the service. The photos your customers send are kept with their requests and deleted as described in the privacy note.
9. Privacy
How we handle personal information is described in the privacy note, which is part of these terms.
10. Changes to these terms
We may update these terms. The date at the top tells you when. Continuing to use CakeQ after a change means you accept it. If you do not, you can delete your account.
11. Law
These terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law rules.
